Payphone is a Discord bot that allows users to make cross-server calls to chat with each other. The service includes features such as in-call messaging, user identification, and user profile management.
You agree to use the Payphone bot only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the bot. Prohibited behavior includes, but is not limited to:
You are responsible for the content you send through the Payphone bot. By using the bot, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content as necessary to provide the service. We reserve the right to remove any content that violates these terms or is deemed inappropriate at our sole discretion.
Our use of your data is governed by our Privacy Policy. By using the Payphone bot, you consent to the collection and use of your data as outlined in the Privacy Policy.
We reserve the right to modify or discontinue, temporarily or permanently, the Payphone bot or any part of it, with or without notice. You agree that we will not be liable to you or to any third party for any modification, suspension, or discontinuance of the service.
We may terminate or suspend your access to the Payphone bot at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Use. Upon termination, your right to use the bot will immediately cease.
To the fullest extent permitted by law, in no event will Payphone, its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the bot; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the bot; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the bot by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the bot; and/or (vi) the defamatory, offensive, or illegal conduct of any third party.
You agree to defend, indemnify, and hold harmless Payphone and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the bot; (ii) your violation of any term of these Terms of Use; (iii) your violation of any third-party right, including without limitation any right of privacy or intellectual property; (iv) your violation of any law, rule, or regulation of the United States or any other country; (v) any claim or damages that arise as a result of any of your user content or any that is submitted via your account; or (vi) any other party’s access and use of the bot with your unique username, password, or other appropriate security code.
These Terms of Use shall be governed and construed in accordance with the laws of Argentina, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms of Use will not be considered a waiver of those rights. If any provision of these Terms of Use is held to be invalid or unenforceable by a court, the remaining provisions of these Terms of Use will remain in effect. These Terms of Use constitute the entire agreement between us regarding our bot, and supersede and replace any prior agreements we might have had between us regarding the bot.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our bot after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the bot.
